Terms of Service

Access to the Platform is granted only upon acceptance of these Terms and Conditions.

Users may accept the Terms by digitally signing this document or by clicking "I agree to the Terms & Conditions" during account creation.

The Platform provides Users with:

• A secure account and data management dashboard,
• Upload interfaces for fan and transaction data,
• Integrations with third-party tools (e.g., CRM, advertising, and analytics platforms).

Users must comply with the terms of any integrated third-party service (e.g., Meta, Google). C'mon Sports Fan Lab assumes no responsibility for their policies or operations.

• Users must provide accurate and up-to-date information when registering.
• Account credentials are strictly confidential. The User is solely responsible for any activity under their account.
• Any suspected breach or unauthorized access must be reported immediately to info@cmon-sports.com.
• Accounts are personal; sharing access with unauthorized third parties may result in suspension.
• C'mon Sports Fan Lab reserves the right to suspend or terminate accounts at its discretion.

• C'mon Sports Fan Lab grants the User a non-exclusive, non-transferable, revocable license to use the Platform.
• Users retain ownership of the data they upload. However, by providing data to the Platform, the User grants C'mon Sports Fan Lab a limited license to process, analyze, and anonymize such data for the purposes of the Services.
• Users warrant that they have all necessary rights and permissions to provide and share this data.

Fees for platform access and services will be communicated in the User's commercial agreement.

Any additional services or user licenses will be invoiced separately.

• Invoices are issued monthly and payable within 30 days of receipt.
• Late payments may result in account suspension without affecting the obligation to pay.
• All legal costs arising from delayed payments will be borne by the User.

• The Platform is periodically updated to ensure optimal performance.
• Routine backups are maintained, excluding raw data uploads.
• C'mon Sports Fan Lab cannot be held liable for temporary downtime or disruptions.
• Support inquiries will receive a response within 72 hours at info@cmon-sports.com.

• Users are solely responsible for the lawfulness, accuracy, and consent of data uploaded.
• Data is encrypted and pseudonymized (hashed identifiers, anonymized records).
• Uploaded data is automatically deleted within 7 days if not processed into the system.
• C'mon Sports Fan Lab operates in compliance with the Swiss Federal Act on Data Protection (nLPD) and the EU GDPR.
• The processing of personal data is governed by our Privacy Policy.
• Users indemnify C'mon Sports Fan Lab against any claims arising from unlawful data processing.

All software, algorithms, dashboards, and analytics generated by the Platform are the intellectual property of C'mon Corporations LLC.

C'mon Sports Fan Lab may use the User's trade name or logo for promotional purposes unless otherwise agreed in writing.

C'mon Sports Fan Lab acts as a data processor under Article 9 nLPD and Article 4(8) GDPR.

Users act as data controllers and are responsible for obtaining valid consent for data collection and transfer.

Both parties agree to treat all shared information, data, and business insights as strictly confidential during and after the collaboration.

The Platform and Services are provided "as is."

C'mon Sports Fan Lab does not guarantee that:

• The Platform will always meet User expectations,
• Access will be uninterrupted,
• All analytics will lead to measurable business improvements.

C'mon Sports Fan Lab's liability shall not exceed the total amount paid by the User during the three months preceding the event giving rise to the claim.

We are not liable for indirect, consequential, or loss-of-profit damages.

Users agree to indemnify C'mon Sports Fan Lab from any third-party claims arising from misuse, unlawful data transfer, or breach of applicable laws.

This Agreement may be terminated by written notice with a 30-day notice period.

C'mon Sports Fan Lab may terminate access immediately in case of breach of these Terms.

These Terms are governed by Swiss law.

Any dispute shall be submitted to the Courts of La Chaux-de-Fonds, Canton of Neuchatel, Switzerland.
